SuisseGold.com facilitates the buying, selling and storage of precious metals. Whether you’re looking to purchase precious metals to add to your portfolio or sell to liquidate part of your assets, we are here to assist you. Learn more about our services here.

1. Agreement Overview

These Terms and Conditions regulate the transactions involving precious metals between SuisseGold.com (“we,” “us,” “our”) and the Seller or Purchaser (“you,” “your,” whether individual, corporation, or other entity). By engaging in any transaction with SuisseGold.com, including through our website or phone services, you affirm that you have the legal right and capacity to enter into this agreement. You also affirm that you have read and accepted our terms & conditions. If you do not agree to these terms, you are prohibited from conducting any transactions with us and must leave our website immediately. The Company reserves the right to update the terms and conditions without prior notification. If in doubt, please check this page regularly for revisions.

2. Website Use:

2.1 The Company may change, suspend or discontinue the websites or the provision of products under the websites, including the availability of any feature, database, or content including storage facilities at any time. This information will be updated in the company’s terms & conditions, and it is up to you to regularly review the terms & conditions.

2.2 You are responsible for obtaining and maintaining any equipment or ancillary services required to connect to, access or otherwise use the websites, including, without limitation, modems, hardware, software, and long distance or local telephone service(s).

3. Rules of Use

3.1 In order to use the websites, to place orders and to receive products via the websites, you must:

(i) Be at least 18 years of age.



(ii) Provide information as requested in accordance with anti money laundering and KYC (Know Your Client) regulations.

 Typically, the KYC information required consists of the completion of an AML (Anti Money Laundering) form, providing copies of national identity documents and a utility bill for all beneficial owners.

(ii) At the sole discretion of the company, a detailed source of funds statement may be requested.



3.2 Information provided during the account signup procedure must be accurate and complete. Should there be any changes to your personal information, we require notification within 14 working days.

 

4. Terms of Prices & Payment

4.1 The websites use a live pricing system provided by FXData.ch; all prices quoted on the site are subject to market change. When you confirm your order through our websites, you are contractually obligated to complete the sale. The prices and availability of bullion products change frequently due to market dynamics. SuisseGold.com sets all buy and sell prices, which may vary rapidly. In the event that there is an error in the pricing data provided by FXData.ch, incorrect pricing or software malfunction we reserve the right to either offer a re-quote or cancel the order. Offers to sell or liquidate bullion are locked in at the current market rates, through our website or via an e-mail offer which is final.

4.2 Goods will not be released or dispatched until The Company is in receipt of full payment of cleared funds via bank transfer. In the event that a client has a negative account balance or owes money on previous orders, cancelled orders, accrued storage fees or any other fees that can be assessed by the company, the company reserves the right to withhold shipping or release goods until the account has been brought up to date.

4.3 Full payment must be made (initiated) within two business days, and we must receive it within eight business days. Delays must be communicated immediately. We reserve the right to report and prosecute fraud.

5. Binding Agreement

5.1 Placing a transaction with us, including an order on our website, creates a binding agreement. By offering to buy or sell bullion, you commit to completing the delivery or payment. Cancellations are not permitted once an order is confirmed. If you purchase bullion and later request a buyback, the transaction will follow our Buyback Terms.

6. Terms to Place an Order

6.1 Orders may only be placed through the websites directly – The Company does not accept orders over the telephone or via email.



6.2 Details provided with each order must be accurate and correct.



6.3 All orders will be confirmed by email within a few minutes of being placed.



6.4 The websites use a Pound Sterling currency feed and all orders are converted into Pounds Sterling on the day that the order is placed. The Company does not hedge foreign exchange rates for its clients and is not responsible for currency fluctuations. In the event of order cancellation, the value of the net refund due is calculated using the Sterling rate that was applied to calculate the conversion on the day that the order was placed.

6.5 Your order is an offer to purchase bullion from us, which is subject to our acceptance. 


6.6 All orders are subject to verification, payment and product / market availability.



6.7 If the products ordered are not available, you will be notified by The Company via email using the contact details you have provided and you will have the option either to:



(i) Wait until the products are available from stock.

(ii) Request different stock items of the same value (at the time of order).


(iii) Receive a full refund of the price paid.

7. Email Confirmation and Communication

7.1 Upon placing an order, you will receive a copy of your invoice via email. You must ensure you can receive our emails by managing your spam filters and updating your address book.

7.2 Account notifications are not sent routinely. These may be turned on in your ‘MyVault’ account when you are logged in should you wish to receive them.

8. Terms of Delivery

8.1 After we receive your payment, we will ship your order within the allotted time frame published on our website, which may vary depending on market conditions, subject to product availability. Ensure your shipping address is accurate and that you are available to receive the shipment. Delays may occur due to high demand or reduced supply, and we will notify you of any significant delays.

8.2 Delivery will be made to the address specified by you when you place your order. The Company does not deliver to P.O Box addresses. Orders are dispatched on working days only between Monday and Thursday. Due to conditions stipulated by the shipping insurance policy held by the The Company, shipments are not dispatched on or the day before public holidays or weekends. Goods will not be released until full payment is received.



8.3 The delivery fee applicable to order will be set out clearly during the checkout process.



8.4 When goods are shipped, The Company will provide tracking information via email within one business day from the date of dispatch. It is the responsibility of the client to ensure that they are present at the address for the delivery and to sign for the goods in person. Claims arising from packages being signed for by an individual unknown to the buyer or other circumstances involving any other third party at the delivery address are at the risk of the client. Shipments that are refused and / or returned to The Company are at the risk of the client. Shipments delivered when you have not made yourself available to sign for the delivery are at your risk.

8.5 International shipments may be subject to inspection by local customs or the carrier. The Company is not able to guarantee that 'sealed' items will be delivered 'sealed' as they may be opened for inspection. Items opened for inspection by customs officials will be resealed with official 'customs' tape.



8.6 You are responsible for any customs fees, duties, taxes, and additional charges not guaranteed or covered by The Company that may be assessed on international shipments.

 8.7 All shipments must be visually inspected prior to acceptance. If a package appears to be have been opened or damaged in transit, it should not be accepted unless it has been officially opened and resealed by a government or customs agency. Claims of short counts or items missing from packages which arrive damaged or opened will not be entertained. Prior to dispatch, the contents of all packages are verified by at least two members of staff.



 8.8 In the event that a shipment is refused by the recipient or undeliverable at the designated address, the client is responsible for all return shipping costs and associated customs clearance fees. Return shipping fees are usually no less than $120 (or currency equivalent).

 8.9 Orders in excess of $2,500 (or currency equivalent) may be split across several packages depending on the destination.

 8.10 Products labeled as ‘VAT-Free’ or ‘storage only’ are typically available for storage only, and may not be available for delivery.

9. Storage



9.1 The Company offers physical bullion storage for clients wishing to store their purchase(s) securely. The bullion may be stored, shipped or sold back to The Company by using the ‘My Vault’ facility. Shipment or collection of bullion is subject to accounts being in good standing. Vault orders will not be released if funds are outstanding for storage, shipping or other unpaid orders. Items may be sold back to The Company from storage. Please note that funds may only be transferred to the bank account that they originated from, and the account must be in the name of the client.

 9.2 All storage accounts are offered free of charge for the first 365 days. Thereafter accounts are subject to a monthly fee, as per the vault storage fee schedule. It is the responsibility of the client to ensure that account fees are paid promptly. Clients must pay storage fees regularly, or keep a balance in their account to cover storage fees. Storage fees after the first 365 days are calculated as follows:

9.3 Accounts in arrears are subject to a fee of the greater of $12 (or currency equivalent) or 1% of the outstanding balance per month. Fees begin to be assessed 90 days after accounts have a negative balance. Fees will continue to be charged until the outstanding account fees are paid. 

9.4 In the event that a client refuses to pay account fees, The Company reserves the right to:

(i) Refuse to conduct any further business with the client, including processing any withdrawal, transfer, delivery or new order requests.

(ii) Sell a portion of the client’s holdings in order to cover their outstanding debts.

(iii) Terminate the business relationship with the client. In the event the relationship is terminated, The Company will provide the client with 30 days notice, during which time the client may settle their outstanding debts. At the close of 30 days, any outstanding positions will be liquidated, and the funds transferred back to the client at the current purchase rate offered by The Company.

9.5 In the event that a client's storage bill exceeds the value of his or her bullion account, The Company reserves the right to liquidate the client's holdings in order to cover the outstanding debt.

9.6 All bullion in storage is insured against theft and damage as a result of fire, flooding or explosion only.



10. Terms of Cancellation

10.1. The Company reserves the right to cancel any order at its sole discretion.

10.2 For orders where the price is subject to fluctuations in the financial markets, the right for the buyer to cancel under the "The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013" (the distance selling regulations) does not apply. Clients that wish to cancel such orders will be liable to the greater of a cancellation fee of 2% of the invoiced value of the order or a minimum cancellation fee of $120 (or currency equivalent) on the day of cancellation.

10.3 If a client cancels or defaults on an order without the express permission of The Company, it shall render the account delinquent.



11. Terms of Liability

11.1 We reserve the right to refuse service, correct errors, cancel transactions, require wire transfers, withhold shipments or payments for unpaid orders, and apply other security measures as needed.

11.2 Your use of the websites is at your sole risk. The content is provided to you as is without any warranties included, expressed or implied. The Company disclaims all warranties, including any warranties of merchantability, non-infringement and use for particular purpose. In particular, we make no warranty that the content of the websites are error-free and timely with all updates.

11.3 The Company will not be liable for damages of any kind, including those resulting in the use of the inability of the use of the websites, from goods or services acquired from the websites or from any contented posted on the websites by us or anyone else. We will not be liable for any indirect, incidental, consequential, special or punitive damages of any kind, including, but not limited to, damages for loss of profits, use, data or other intangibles, even if we have been advised of such possibility of damages.

12.1 Governing Law: These Terms and Conditions are governed by the laws of the British Virgin Islands. Any disputes must be filed within one year of arising in writing

12.2 Limitation of Liability and Indemnity: Our liability is limited to the purchase or sales price agreed upon. We are not liable for indirect, incidental, or consequential damages. You agree to indemnify us against any claims arising from your use of our services.

12.3 Force Majeure: We are not liable for failures to perform due to causes beyond our control, such as natural disasters, government actions, or market disruptions.

13. Complete Agreement

These Terms and Conditions, along with our Privacy Policy and any purchase orders, constitute the entire agreement between you and SuisseGold.com.

14. Modification of Terms

We may change these Terms and Conditions at any time. Continued use of our services constitutes your acceptance of any changes.
